These Terms of Service ("Terms") govern your access to and use of DocNearby's website, mobile application, and services (collectively, the "Service") operated by HashData (Pty) Ltd, trading as DocNearby ("DocNearby," "we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

3. Description of Service

DocNearby is a worldwide healthcare appointment booking platform that connects patients with healthcare practitioners. Our Service allows:

• Patients to search for and book appointments with healthcare providers
• Healthcare practitioners to manage their practice profiles and schedules
• Secure communication between patients and providers
• Payment processing for healthcare services

4. User Accounts

4.1 Account Registration

To use certain features of our Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account

4.2 Account Types

Patients: Individuals seeking healthcare services
Practitioners: Licensed healthcare providers offering services

5. Practitioner Verification

Healthcare practitioners must provide valid licensing information and undergo verification. We reserve the right to:

• Verify professional credentials and licenses
• Suspend or terminate accounts with invalid credentials
• Require additional documentation as needed

6. Payment Terms

6.1 Payment Processing

Payments are processed through our South African payment provider. By making a payment, you agree to the payment provider's terms of service and privacy policy. DocNearby does not store credit card information on our servers.

6.2 Fees and Charges

• Consultation fees are set by individual practitioners
• Payment is required at the time of booking
• DocNearby may charge platform fees as disclosed during booking
• All fees are in USD unless otherwise specified

6.3 Taxes

You are responsible for paying all applicable taxes related to your use of the Service.

7. Refund Policy

7.1 Cancellation by Patients

• More than 24 hours before appointment: Full refund
• Less than 24 hours before appointment: 50% refund
• No-show or same-day cancellation: No refund

7.2 Cancellation by Practitioners

If a practitioner cancels an appointment, patients receive a full refund processed within 3-5 business days.

7.3 Refund Processing

• Refunds are processed through the original payment method
• Processing time: 3-5 business days for most payment methods
• Platform fees are non-refundable unless the cancellation is due to practitioner unavailability

7.4 Dispute Resolution

For payment disputes, contact support@docnearby.io within 30 days of the transaction.

8. User Conduct

You agree not to:

• Violate any applicable laws or regulations
• Impersonate another person or entity
• Provide false or misleading information
• Harass, abuse, or harm other users
• Share inappropriate or offensive content
• Attempt to gain unauthorized access to the Service

9. Medical Disclaimer

IMPORTANT: DocNearby is a platform that connects patients with healthcare providers. We do not provide medical advice, diagnosis, or treatment. All medical decisions should be made in consultation with qualified healthcare professionals.

10. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information in accordance with the Protection of Personal Information Act (POPIA).

11. Intellectual Property

The Service and its original content, features, and functionality are owned by HashData (Pty) Ltd and are protected by South African copyright, trademark, patent, trade secret, and other intellectual property laws.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

13. Limitation of Liability

To the maximum extent permitted by law, DocNearby shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or goodwill.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.

15. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify users via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
